  1. General

The General Terms and Conditions of the WWW.KOZJANSKI-DVOR.SI online shop are drawn up in accordance with:

Recommendations of the Chamber of Commerce and Industry and international e-commerce codes

The General Terms and Conditions of Business are drawn up in accordance with the consumer protection regulations, based on the recommendations of the Slovenian Chamber of Commerce and Industry and the international codes for online and electronic commerce. The online shop WWW.KOZJANSKI-DVOR.SI (hereinafter referred to as the “Online Shop”) is operated by TURISTIKO D.O.O., KOZJE 50A, 3260 KOZJE, a provider of electronic commerce services (hereinafter referred to as the “Trader”).

You can purchase as a registered user or as a guest. Each registered user is given a password and a username with which to introduce themselves. The password is confidential and known only to the user.

When registering, the user must enter the following information

The Administrator is not responsible for the accuracy of the information provided by the user at the time of registration.

By registering, the visitor confirms and warrants that he/she is a person of legal age and of full legal capacity.

Purchase option for legal entities, online shopping for legal entities, the seller and the buyer agree on a contract in which they write down the terms and conditions of the business, such as.

These General Terms and Conditions define the operation of the online shop, the rights and obligations of the visitor, the user and the buyer, and the business relationship between the Trader and the user as a buyer of products from the online shop.

2. Accessibility of information

The trader undertakes to make them available to the user at all times:

  • the identity of the Trader (in particular the company name and registered office);
  • contact details to enable the user to communicate quickly and effectively with the Trader (email address, telephone, etc.);
  • information on the essential features of the products or services offered by the online shop, including after-sales services and guarantees;
  • information about the availability of products or services offered by the online shop;
  • the manner and conditions of delivery of the products or services, in particular the place and time of delivery;
  • information on how to pay;
  • information about the validity period of the offer from the online shop;
  • information on the period during which it is still possible to withdraw from the contract and the conditions for withdrawal;
  • information on the possibility of returning products and if and how much such returns cost the user;
  • information about the User complaint procedure and the contact details of the Trader’s contact person for Users.

3. DELIVERY AND COLLECTION OF ORDERED PRODUCTS

Due to the nature of doing business online, the product range in the online shop changes and is updated frequently and quickly. The Administrator undertakes to process each order on the same day or upon receipt of payment. If for any reason this is not possible, the Administrator shall inform the Customer accordingly.


The digital voucher will be sent to the e-mail address entered by the subscriber upon payment.

The online price applies to all registered and non-registered users of the Trader’s online shop.

All prices in the online shop are quoted in euros and include VAT, unless explicitly stated otherwise.

All prices are valid at the time of ordering and have no pre-determined validity and are therefore valid only until changed from time to time. Despite the Merchant’s best efforts to provide the most up-to-date and accurate information, it is possible that a price may be incorrect. In the case referred to in the preceding sentence and in the event that the price of the product changes during the processing of the order, i.e. from the moment of placing the order until the order is confirmed, the Merchant shall:

  • notify the user (customer) of the new prices, in which case the user (customer) shall have the option of modifying or cancelling the order in whole or in part or confirming the order at the new prices, all at no additional cost; or
  • enable the user (buyer) to withdraw from the purchase and at the same time offer a win-win and mutually satisfying solution.

6. PURCHASE PROCEDURE

The user selects the products and uploads them to the basket. After selecting the Products, the User can select the Products before placing the order.

After placing an order, the customer receives an email notification that the order has been accepted into the management information system. The status of such order is accepted and does not oblige the Administrator to provide the products ordered until such order has been confirmed.

The user can cancel the order within 2 hours from the confirmation of the acceptance of the order. If the user does not cancel the order, the order will be processed. The order is reviewed by the order manager, who checks the deliverability of the products ordered and confirms the order or rejects it for a reason. The Administrator may call the Customer’s contact telephone number to verify the information or to ensure the accuracy of the delivery.

For goods that the Administrator does not hold in stock, the Administrator is bound solely by the supplier’s delivery and the time within which each supplier can deliver the product to the Administrator. The Purchaser shall be informed by e-mail by the Administrator of the delivery of the products.

If the delivery time is too long and the buyer does not want to wait, the buyer can tell the administrator. The Administrator will remove the product from the order and refund any purchase price to the buyer, and will either deliver the remaining products in the order or cancel the entire order at the buyer’s choice. The contract between the Buyer and the Seller for the purchase of the products ordered is thus irrevocably concluded. For orders where the Seller suspects abuse, the Seller shall have the right to contact the Buyer and verify the order.

The Seller accepts no liability for damages resulting from longer delivery times or from the non-delivery of goods which the Manager does not hold in stock.

7. Purchase Agreement

The trader shall issue an invoice in writing to the user who purchases a product from the online shop, itemising the costs and explaining the right to withdraw from the purchase by returning the purchased product, if necessary and possible. The purchase contract in the form of a purchase order is stored electronically on the Merchant’s server and is accessible to the User (Buyer) at any time in his/her user profile. The Purchase Agreement shall be concluded in the Slovene language.

The purchase contract between the Merchant and the User (Buyer) is concluded at the moment the Merchant confirms the order. From that moment on, all prices and other conditions of purchase are fixed and apply to both the Merchant and the User (Buyer).

8. RIGHT OF WITHDRAWAL, RETURN OF PRODUCTS

Right of withdrawal under Article 43 of the VAT Act

Under the Consumer Protection Act, the buyer has the right to notify the supplier within 14 days of taking delivery of the goods that he or she is withdrawing from the contract, without having to give a reason for his or her decision. The buyer may give notice of withdrawal to the company on the form referred to in the fifth paragraph of this Article or by an unequivocal statement making it clear that he is withdrawing from the contract. In this case, the supplier shall immediately send the buyer an acknowledgement of receipt of such withdrawal form by e-mail on a durable medium.

The goods must be returned to the tenderer within 10 days of the date of the cancellation notice. The goods shall be deemed to have been returned by the Buyer in due time if they are sent before the expiry of the 10-day return period.

The refund will be made within 10 days of receipt of the cancellation notice. The Provider may withhold the reimbursement of the purchase price received until receipt of the returned goods. The returned product must be unused, undamaged and in its original packaging.

The return of the goods received to the tenderer within the withdrawal period shall be deemed to be a communication of withdrawal from the contract.

9. Warranty

Products are guaranteed if stated on the invoice or warranty card. The warranty is valid subject to the instructions and conditions stated on the warranty card and on presentation of the invoice. The warranty period is indicated on the warranty card or on the invoice. Warranty information is also given when the product is presented in the online shop. If there is no warranty information in the online shop, then the product has no warranty.

The user (buyer) can claim the warranty directly from the manufacturer of the product or its authorised service centre. The warranty can be claimed by the buyer by means of a warranty certificate and an invoice.

10. Safety

The trader shall use appropriate technological and organisational means to protect the transmission and storage of personal data and payments. For these purposes, the Merchant uses a 128-bit SSL certificate issued by an organisation authorised for this purpose.

Secure credit card authorisations and transactions are handled by Credit card – Braintree Payments. Credit card authorisations are carried out in real time with instant data verification with the banks. Card data is not stored on the Merchant’s server.

It is also the user’s responsibility to ensure the security of their username and password, and to ensure that their computer is protected by appropriate software and anti-virus protection.

11. Childcare

The trader shall not accept orders in the online shop from someone he knows or suspects to be a child without the express permission of the child’s parents or guardians. The trader shall not offer free access to products or services in the online shop that are harmful to children.

The trader will not accept any personal data concerning children without the express permission of the parents or guardians, nor will the trader disclose any data received from children to third parties other than the parents or guardians.

Any communication aimed at children will be age-appropriate and will not exploit children’s trust, lack of experience or sense of loyalty.

12. Privacy Policy

The Privacy Policy is also part of these General Terms and Conditions and is available on page 1 of the Merchant Portal.

13. User reviews and product ratings

Product reviews, comments and ratings provided by users or visitors are part of the functionality of the online shop and are intended for the user community.

The trader is not responsible for the content of opinions, comments and product reviews provided by users or visitors. The Merchant shall review opinions, comments and reviews before publication and shall reject those that are manifestly untrue, misleading, offensive, obscene or, in the Merchant’s opinion, do not provide any benefit to other users or visitors to the online shop. The Merchant is not responsible for the information contained in reviews, comments and ratings and disclaims any liability arising from such information.

By submitting an opinion, comment or review, the user or visitor expressly agrees to the Terms of Use and authorises the Merchant to publish part or all of the text in all electronic and other media. The Merchant shall have the right to use the content of the opinion, comment or review for an unlimited period of time and for any purpose in the Merchant’s commercial interest, including publication in advertisements or other marketing communications. The author of the opinion, comment or review also represents and warrants that he/she is the owner of the material and moral copyrights in the opinions, comments or reviews written and that he/she assigns these rights to the Merchant free of charge, non-exclusively and in perpetuity.

14. Responsibility

The Trader shall use its best endeavours to ensure that the information published in its online shop is up-to-date and correct, but the characteristics of the products, the delivery date or the price may change so rapidly that the Trader is unable to correct the information published in its online shop in a timely manner. Although the Trader endeavours to provide accurate photographs of the products for sale in its online shop, all photographs should be taken as symbolic. Photographs do not guarantee the characteristics of a product.

The trader shall not be liable for any physical damage, destruction or loss of the consignment from the moment the consignment of the products ordered is delivered to the post office, or if the contents of the consignment are missing or if the consignment shows signs of having been opened. In these cases, the user (buyer) must initiate a complaint procedure with the delivery service. In the event of damage to the consignment, he/she shall do so by bringing the consignment to the nearest delivery service unit, in the same condition as received, without adding or removing anything, and completing a claim report. The trader will work with the delivery service to ensure that the complaint is resolved as quickly as possible.

15. Complaints, disputes.

The trader complies with applicable consumer protection laws. The trader has an effective complaints handling system in place and has a designated person who can be contacted by phone or email in case of problems. The complaint procedure is confidential.
The provisions of the Code of Obligations, the Electronic Commerce Act, the Personal Data Protection Act and the Consumer Protection Act shall apply mutatis mutandis to all relationships and rights and obligations not governed by these General Terms and Conditions.

16. Changes to the General Terms and Conditions

In the event of changes in the regulations governing the operation of online shops, data protection and other areas related to the operation of the online shop of the Trader, and in the event of changes in its own business policy, the Trader may amend and/or supplement these General Terms and Conditions, which will be notified to users in an appropriate manner, including in particular by means of the WWW.KOZJANSKI-DVOR.SI web portal. Any amendments and/or supplements to the General Terms and Conditions shall come into effect and shall be applied at the end of an eight-day period from the date of publication of the amendments and/or supplements. If a change and/or amendment to the General Terms and Conditions of Business is necessary to comply with regulations, such changes and/or amendments may exceptionally enter into force and application within a shorter period of time.

A User who does not agree with the amendments and/or additions to these General Terms and Conditions must cancel his/her registration within eight days of the publication of the notice of the amendment and/or addition to the General Terms and Conditions, otherwise, after the expiry of this period, the User shall be deemed to have accepted the amendments and/or additions to the General Terms and Conditions and no evidence to the contrary shall be admissible. Cancellation of registration shall be made by the User notifying the Merchant of the cancellation by written statement.

Browsing our online shop with cookies is more pleasant, faster and more efficient. Each visitor receives a cookie at the start of their visit to identify and keep track of their shopping basket.

Cookies are only stored in the server’s memory for the duration of the visit and are deleted after one hour of inactivity, while persistent cookies are stored on the visitor’s computer.

18. PROMOTIONS, DISCOUNTS

All or selected products may be occasionally discounted due to seasonal promotions for a limited period. Discounted products will have a new discounted price clearly displayed alongside the regular retail price. If a particular product has a promotional price due to stock clearance, the customer shall be informed before purchase whether the product is in stock or out of stock.

Discount vouchers

With the occasional promotional code, the customer can receive a discount, which is valid exclusively in the online store WWW.KOZJANSKI-DVOR.SI

The voucher, when redeemed, grants the selected discount on the total amount of the order.

Discounts on products already discounted in the online shop are not valid when the voucher is redeemed. Coupons and discounts are not cumulative.

Each customer can redeem only 1 voucher with their voucher per purchase.
